U.S CITIZENSHIP AND IMMIGRATION SERVICES (USCIS) ISSUES NEW I-9 FORM — EFFECTIVE IMMEDIATELY

On November 7, 2007, USCIS issued a revised Form I-9, the Employment Eligibility Verification Form. The most significant change to the Form is the elimination of five documents from List A of Acceptable Documents. The revised Form I-9 is the only version that is valid for use. All previous versions are no longer valid. Accordingly, employers should begin using the new Form immediately for all new employees hired on or after November 7, 2007 and for all employees who require re-verification on or after that date. Employers will be afforded a period of time to transition to the new I-9 Form. The Department of Homeland Security (DHS) will publish a notice in the Federal Register announcing that it will not seek penalties against an employer for using a previous version of the Form during the transition period, which will end 30 days after the publication of the notice. We will advise you when the notice is published.
